32 Protection of Judges and magistrates etc.

Section titled “32 Protection of Judges and magistrates etc.”

(1) A Judge or magistrate has, in the performance or exercise of a function or power under this Part or Part II of the Act, the same protection and immunity as a Judge of the Supreme Court of the State or Territory in which the function is performed or the power is exercised.

(2) A barrister or solicitor representing a person at an inquiry being held by a Judge or magistrate has the same protection and immunity as a barrister has in appearing for a party in proceedings in the Supreme Court of the State or Territory in which the inquiry is being held.

(3) A person who:

(a) appears before an inquiry being held by a Judge or magistrate; and

(b) is not represented by a barrister or solicitor;

has the same protection and immunity as a party to proceedings in the Supreme Court of the State or Territory in which the inquiry is held has in appearing before that Court when not represented by a barrister or solicitor.

(4) A person summoned to attend, or appearing at, an inquiry being held by a Judge or magistrate to give evidence or produce documents or things has the same protection as a witness in proceedings in the Supreme Court of the State or Territory in which the inquiry is held.
